United States Foreign Policy The world today is ravaged by weather disasters, economic disaster, diplomatic disputes, and even military conflict. The United States puts these issues into a category called foreign policy. Foreign policy is defined as a government s strategy in dealing with foreign affairs. (â€Å"Foreign Policy,† 2017) The United States has the challenge of facing all of these problems on a daily basis. Whether it is resolving issues in the South China Sea, or aiding countries damaged by natural disasters, the US foreign policy is at work. Australian Immigration Law Congressional Drafting

Question: Describe about the Australian Immigration Law of Congressional Drafting. Answer: Introduction An Australian court case named Waensila v Minister for Immigration and Border Protection [2016] FCAFC 32 has created a new pathway for all the individuals who have applied for partner visa under sub class 820 in Australia. The judgment of the said case has over ruled the decision of the lower courts and changed the manner in which Schedule 3 waiver in relation to partner visa under sub class 820 was interpreted (Hamano, 2010). Summary Facts In the said case, the appellant had Thailand citizenship who married a woman of Australian nationality on 5 September 2010. The appellant made an application for a permanent and temporary partner visa under sub class 820 and 801 on 10 September 2010 based on his marriage with an Australian citizen. The appellant had arrive in Australia on visitors visa which was expired long back before application of partner visa making him have no substantive visa at time of partner visa application. His application for partner visa was rejected by the Immigration officer stating the reason failure of compliance with requirements states under Clause 820.211(2) (d)(ii) of the Migration Regulations 1994 (Waensila v Minister for Immigration and Border Protection, 2016). The appellant brought bout an action against the order passed by the immigration officer but the Tribunal agreed with the decision of the immigration officer. The appellant eventually opted for judicial review arguing that the decision of the Tribunal in Federal Circuit Court of Australia was unsatisfactory however, the same order was upheld. Lastly, the said appeal was filed by the appellant in the Federal Court of Australia (Migration Act 1958, 2004) Reason for Judgment of the Federal Court of Australia The said case is a classic example of how judges in the Court interpret the wordings of the section to derive the true intent of the Legislation while drafting the same. In the current case, the Clause 820.211(2) (d) (ii) of the Migration Regulations 1994 was interpreted to arrive at the judgment. The Clause 820.211(2) (d) (ii) of the Migration Regulations 1994 talks about the conditions 3001, 3003 and 3004 mentioned in Schedule 3 have to be satisfied by an applicant of partner visa unless he can prove to the Ministry that certain compelling and compassionate reasons were present at the time of partner visa application which precluded he applicant to comply with the conditions (Odhiambo-Abuya, 2003). The primary feature of this section is that it authorizes the Ministry with huge discretionary powers in determining the validity of compelling and compassionate reasons. The appellant in this case failed to fulfill the requirements stated under Clause 820.211(2) (d) (ii) of the Migration Regulations 1994; however he provided various compelling situations that prohibited his compliance of requirements. These compelling reasons are as follows:- The Appellant was a Muslim citizen who feared being victimized and abused if he returned to his country The Appellant feared that his relationship with wife would be adversely affected The appellant believed that his reunion with his wife would never be possible if he returned back to his community in Thailand Additionally, the appellants wife was suffering from many diseases and require he appellant for care The appellant was supporting his wife financially (Waensila v Minister for Immigration and Border Protection, 2016) Judgment passed by Lower Court The Judge of the Lower Court interpreted Clause 820.211(2)(d)(ii) of the Migration Regulations 1994 in a manner which gave the wording of the section at the time of the application great important which require compelling situations to exist at time of partner visa application. However, in the case of appellant, compelling reasons arose after the partner visa was applied; thus, appellants partner visa application was rejected. Judgment passed by the Federal Court The Federal Court passed its judgment on the said matter on March 11, 2016 where it reserved the order of the Lower Court. The judge of the Federal Court expressed that the discretionary powers provided to the Ministry to determine the validity of compelling situations cannot be limited to a time frame of the said compelling situation existing only at the time the visa application was made. Thus, the judges of the Federal Court interpreted the wordings of the Clause 820.211(2)(d)(ii) of the Migration Regulations 1994 relying on the judgment of Berenguel v Minister for Immigration and Citizenship that stated heading of any section are not necessarily related to the content or the meaning of the section. Thus, the heading of any section does not define its meaning completely and thus the time frame for compelling reasons to arise cannot be restricted. Thus, the waiver option available for applicant of partner visa can rely on compelling conditions which exist after visa application for being granted appropriate waiver (Vrachnas et al., 2011). The judges of the Federal Court also referred to section 65 of the Migration Act 1958 which authorizes the immigration Ministry, the authority to grant or reject visas in Australia. Thus, the time frame to determine whether any visa application satisfies all the conditions mentioned in Migration Act 1958 and Migration Regulations 1994 should be the time when the decision of the status of the visa is determined. Additionally, Section 55 of the Migration Act 1958 states that the Ministry should use its discretionary power while deciding whether to grant or reject a visa application in Australia after reviewing all the important issues and information in each visa application. Thus, the said case is an ideal example of the fact that judges in the Court interpret the sections and clauses in Australian law. After the judgment of the said case, it is very clear that Immigration Ministry cannot refuse any partner visa application if the applicant can validly prove that certain compelling situation arose which prohibited him from complying with Clause 820.211(2)(d)(ii) of the Migration Regulations 1994. The said compelling reasons can even arise after the partner visa application is made and the requirement of compelling reasons to exist at time of visa application was considered invalid. Thus, with the said decision, the Courts proved that they interpret sections and clauses with the intent to advance the intent of the Australian Legislation while drafting the said clause or section. 2: In the judgment of Waensila v Minister for Immigration and Border Protection [2016] FCAFC 32, the judges of the Federal Court used Golden Rule of Interpretation of Statutes. The Golden Rule of Interpretation is used where a statute is absurd or unclear; therefore the judges apply an approach where they deviate from the usual meaning of a section or a statute in order to clarify the absurdity in the statute or a section. Therefore, using Golden Rule of Interpretation of Statue, a judge is permitted to alter the meaning of a section to get rid of an illogic or absurd result it creates. The primary object on which the Golden Rule of Interpretation of Statue stands is to promote the intention of the Legislation (Gluck Bressman, 2013). Under the said rule, the primary motive of the Judges is to advance the meaning of a statute which promotes the intention which the Legislation had while drafting the same. In the present case, the judges of the Federal Court interpreted Clause 820.211(2)(d)(ii) of the Migration Regulations 1994 after analysis the intention of the Legislation while drafting the same (Malleson Moules, 2010). The intention of the Legislation in authorizing the Ministry with discretionary powers to either grant or reject partner visa after considering validity of compelling reasons for to reduce the hardship faced by the applicants of partner visa, therefore, restricting the time for the said compelling reasons to be considered would defect the intention of the Legislation. Therefore, to avoid the confusion which the wording at the time of application in the clause was bringing, the said wording was interpreted in a broader manner with the help of the Golden Rule of Interpretation of Statute to promote the intention of the Legisation while drafting the same (Bressman Gluck, 2014). Effective Articles or Not essays From 1781 to 1789, the Articles of Confederation have been known to provide the United States with an ineffective form of government. Soon after the Revolutionary War in America, the Continental Congress adopted the Articles of Confederation, while a new government was being started. These Articles were brought to set up a democratic government that gave the States the power to make their own laws and to enforce them. However, from my perspective, these Articles did not provide the United States with an effective government. During the time of this period, regionalism and disorder was being developed by the Continental Congress controlling the public affairs, while there was nothing in the Articles that gave Congress the power to enforce laws or unify the States. Also, there wasnt any solid monetary system to ensure that taxes would be paid or to protect commerce about nationally and foreign trade, and the country lacked unity and strength because there was no leadership. One of my reasons for the Articles not being effectual is the fact that Congress only had the power to recommend actions to the States. This could not be put into effect its recommendations or laws. Each State had its individual constitution, monetary system, and means to enforce the law. Each State also had a stronger commitment to the State laws and to the State's own self-interests, rather than to the recommendations of Congress. Regionalism eroded one State against another. This decreased the sense of unity in the country. For example, when Congress recommended a sense of duty on imported goods, the State of Rhode Island voted to reject the idea because they felt it was unfair and was against the constitution of the state. The Articles also failed to provide a solid monetary system to ensure that taxes would be paid or to protect commerce. Congress had no way to collect taxes to pay off pre-war debts. We let ourselves learn and experience slowly but surely. Every step is complex to the extent that the whole routine might be ruined when you did it thoughtless or unprepared. Discipline and patience are two major factors needed to dance with grace and style. Also, dancing imparts to us the need to take into consideration the history of the dance you’re interested to for us to be able to grow from time to time from our mistakes or committed errors. Dancing also need the performer to be self-confident and independent – being brave enough to gain his dream, his passion and his aim to fame. Life is also an art, like a dance. You have to be creative to produce magnificent performances and flexible enough to adapt from the ups and downs of rehearsals and few blunders around. A true performer dance not to compare himself to anyone but to dance better than one self. As you learn more as time passes by, one must enjoy each step along the way for him to be exultant on what he loves to do. Sometimes steps are fast and tough or gentle and stress-free. But the result will depends not on the routines, but on how you dance the piece. Interpretive dance will be my piece if I have to choose. This particular dance defines my life as well. Movements are based on human expressions and feelings. I’m used to show what I feel towards the people who surround me. Also, I have high regard about freedom and personal expressions. Movements in this kind of dance are also communicating to the viewers. â€Å"Actions speak louder than words. â€Å" – This old little saying, I believe, is true. One can show the sincerity and truthfulness more when it is communicated with actions. Often the style includes grand, eloquent movements which, in my opinion, are the reason why it is associated with higher form of arts. Imagination is greater than knowledge. Creativity is of much more value here than the other types of dance. We can dance for laughter, for tears, for love, for pain, for fears or even for madness. Dancers create their own character by a dance full of passion and by dancing not just with a foot but most of all, with a heart even with music or without.

The Bear A parody by Fritz Karl Wilhelm Mueller The wind wailed through the towering pines of Grand National Park. The sun illuminated the landscape. Those pines were more than five hundred years old. They stood unchanging like the forest itself. The animals lived in a flawless balance with nature. No humans had ruined this pristine wilderness for some time. The trails overgrew with shrubs. Gathering, clouds brought an ominous dread to the forest. It became darker by the minute. Suddenly, lightning brightened the terrain. As the rain pummeled the forest, most of the animals darted in fear. Not all the animals were terrified of the storm. The bear roared in delight. The master of the animals in this forest was the bear. The bear was hardy. His general color is black above and brownish dark below. His legs were very powerful. He could use his hind legs to stand upright. His front legs could get to hard to reach places. He had a keen sense of smell and hearing but a less well developed sense of sight. This bear had an omnivorous diet. The bear liked eating fish, termites, ants, honey, fruit and nuts. The bear could catch his meals with incredible speed. Trees, water or land did not stop him from his prey. This bear preferred to be alone. He did not like to share food or care for the young. Caring for the young would be left to his mates. Yet he possessed much wisdom. The bear saw a new animal in the forest today. The other animals in the forest were afraid of this new animal. This new animal walked on two feet. It was about six feet tall. The new animal also wore clothing. How was the bear to know that this new animal was a human? The bear started to walk towards the human in curiosity. The human noticed the bear. Then the human took out a gun. The human fired the gun at the bear. The bullet barely skimmed the bear. The bear immediately took off. Although the bears' stomach growled in hunger, he did not care about fish, insects, honey or fruits. The bear only needed to survive. The human started to pursue the bear. The bears' only hope for survival was to run deeper into the forest. The bear would have to go through precarious and craggy terrain if he went deeper into the forest.

Against School essay

Rhetoric and Composition 1020 18 September 2012 Ask any student in public high school what they like and dislike about school. Odds are, they will say that what they enjoy most about school is the social interactions it allows them to take part in, and what they dislike about school is the classes. John Taylor Gatto, in â€Å"Against School: How Public Education Cripples our Kids, and Why,† discusses the reasons for such boredom in an in depth manner. Most of the time, nowadays, it is not the amount of work that they have developed a disliking for, it is the time that being in class wastes.Sitting in a class doing busy work is not something that interests people. The problem with schooling in this day in age, is that many of the students attending public schools are not being challenged and brought to their full potential. Teachers get bored of teaching and students get bored of doing work that is not going to benefit them in any way after they graduate high school. John Taylo r Gatto gives a brief summary of the history of schooling and a suggestion that, in order to better our children academically, teachers need to urge their students to take on the work that may seem more â€Å"grown up. Schooling first started taking off in the United States between 1905 and 1915. American adapted its idea of public schooling from the Prussians, much like other parts of its culture. John Taylor Gatto states that the three reasons schooling came about was â€Å"to make good people, to make good citizens, and to make each person his or her personal best. † In all reality, however, Gatto says that the worst thing taken from the Prussians was the schooling system. John Taylor Gatto brings about the question of â€Å"why is forced school necessary? The â€Å"six classes a day, five days a week, nine months out of the year. † He proves his point by saying that â€Å"two million homeschool students turned out just fine, along with many other names that Amer icans can recognize such as: George Washington, Benjamin Franklin, Thomas Jefferson, and Abraham Lincoln. † Gatto states that forced schooling only enforces a deadly routine. He also argues that while most people associate the term â€Å"success† with â€Å"schooling† there are many people who are just as successful as the next who have not had as much schooling as expected.He probes the questions: â€Å"why, then, do Americans confuse education with just such a system? What exactly is the purpose of our public schools? † John Taylor Gatto explains that we â€Å"so eagerly have adopted one of the very worst aspects of Prussian culture: an educational system deliberately designed to produce mediocre intellects, to hamstring the inner life, to deny students appreciable leadership skills, and to ensure docile and incomplete citizens—all in order to render the populace â€Å"manageable. † While schooling is provided to enhance the intellects, it really is only designed to create mediocre ones.Parents and students should not have to go through the schooling proccess if it is not going to push them to be their absolute best. Without the proper schooling, it is harder for anyone to begin a career. Gatto explains that teachers do not guide their students to reach their full potential, but rather just give them the information to reach it. Whether they choose to strive for excellence is their choice, but teachers in this century do not push them towards their goals. Ultimately, teachers need to care more about their students futures and academic success.Next, John Taylor Gatto introduces the logistics of public schooling and the actual purpose of forced schooling in six basic functions. These functions are â€Å"the adjustive or adaptive function† which establishes reactions to authority. Teachers have the ability to teach their children to do anything, whether that is to learn or to do reckless things. Children look up to the teachers because they know that they are superior to them, therefore they react and respond to everything they say and do. It is difficult for parents to send their children to school because they are putting their trust in adults they have never met.Within forced schooling, it is likely that students and teachers disagree, and even more likely that a parent will intervene when they do not feel as if the teacher is responding adequately to the students needs. The second function is the â€Å"integrating† function. The schooling system is the definition of conformity. Children come to school everyday at the same time and preform almost identical basic functions in each classroom. They are taught when to talk, when to learn, when to eat, when to socialize, and they all listen and do what they are told and what is normal for them.Students see how other people are acting to certain situations, and then mimic those actions to blend in with the rest of the school. The  "diagnostic and directive† function deals with social roles. During their schooling, children realize what role they play and where they fit in socially. Specifically, high school is the institution where students realize the kind of people they are and what groups they will belong to, what friends they will have, and what everyone else will think of them. The â€Å"differentiating† function sorts the students according to their role and they are only taught as far as they can be as a group and no further.Gatto states here that this undermines the purpose of pushing students to their personal best. The â€Å"selective† function is exactly what it sounds like – selection, like Darwinism. If a student falls short of academic expectations, they receive poor grades and other punishments. The purpose of school is to enrich the students minds, and if they cannot do what is expected of them, they do not receive the benefits of those who do. The final function is the â€Å"propaedeutic† function. This function states that ultimately some of the students who attend school for the full twelve years will cary out the roles of authority some day.Ultimately what John Taylor Gatto argues throughout this essay, is the idea that boredom derives from the source. If a student is bored, it is because he or she is not doing anything the excite themselves, and same goes for the teachers. He suggests that in order to improve the lives of both, teachers need to introduce harder materials to the students. Not only will it keep them occupied and far from boredom, it will encourage them to reach beyond what is easy. Health Care Communication Paper Essay

Our facility is going to be changing a lot in the weeks and months to come. As the administration of the nursing home, I am going to make sure that this transition happens as smoothly as possible. The patients that have decided to stay must try their hardest to adhere to the new policies that have been set. The patients that have decided to go somewhere else will very greatly missed. The patients who cannot communicate their decision for one reason or another will be placed where the staff and I see fit, whether it be in our facility or somewhere else. This facility wants to ensure all patients and residents that we want to make these changes as painless as possible. Thank all of you for the time you have given the staff and me these last ten years, and for the time you will give in the future. There are three different types of communication in the medical field: traditional communication, electronic communication, communication through social media. There are advantages and disadvantages to each different type of communication. Traditional communication includes speaking face to face and mail (letters). Electronic modes of communication are email phone (home or cell phone), texting, and chatting. Social media involves communicating with several people or just one person at a time using public forums or private messaging through such websites facebook and twitter. Each and every type of communication is equally as important as the other but they all have their own advantages and disadvantages. Traditional forms of communication as simple as can be but they can confuse anyone if every step is not done correctly. You would think that speaking to someone face to face would be the best way to communicate but this is not always the case. Anyone can miscommunicate what they are trying to say. There can be other barriers like language barriers and also emotional barriers. If someone speaks a different language it can be hard to understand them unless there is an interpreter available, which isn’t always possible. Emotional barriers are hard because when health care is involved things can go wrong and people then become angry, sad, and/or tired. When this happens they may not want to listen to or respond to their doctors. Face to face communication is good too because you can ask questions then and there, and receive advice from your physician without having to wait too long. Mail can be very annoying because it can take days or weeks to reach its destination and more days or weeks to receive a response. The only good thing about mail would be that you will have documentation of your physician’s opinions and test results. Traditional communication methods have been around for a long time but times are changing and these types of communication are becoming few and far between. Electronic communication seems to be where most people end up communication, even to our doctors and other health care officials. We call, email, and even text to tell doctors and nurses our health care problems before we even consider actually going to a doctor’s office and speaking to the doctor in person. These communication techniques are good because we can receive answers to our questions also instantly if the health care official isn’t busy. One disadvantage is that someone may not get back to you as soon as you would like; which will leave you at home, wondering what you should do. Electronic communication isn’t exactly the best form of health care because if the doctor cannot actually see the patient and test their symptoms they cannot defiantly tell a patient what is wrong with them. Social media is becoming more and more popular every day because it is a way to keep in touch with people we don’t see every day. It has also become home for all kinds of new and old information, including health care information. This can be a great way to communicate about health care because people can learn new things about health care and medicine every day. People can also communicate with organizations full of doctors and nurses who can teach patients about any news in the health care world and advise patients on how to take care of themselves. This may sound great but there are terrible disadvantages to this type of health care communication. You never know who you are actually speaking to on the internet. What could appear to be an organization of doctors and nurses who want to offer free health care advice could be someone who knows absolutely nothing about medicine. Social media websites are not the best place to look for any sort of medical advice because patients want real help.

Which Colleges Require the SAT Essay Complete List SAT / ACT Prep Online Guides and Tips Planning to take the SAT? Before you sign up, you need to decide whether you’re going to take the test with or without the optional Essay. How should you pick? Well, some colleges require that you apply with the SAT with Essay; others don’t care whether you submit an SAT score with or without the Essay. In this article, I’ll provide you with a complete list of colleges that require or recommend taking the SAT with the Essay. What Is the Optional SAT Essay? The redesigned SAT debuted in March 2016 along with a now-optional Essay section. For the Essay, you have 50 minutes to read a passage (similar to those you see on the Reading section) and write an essay dissecting how the author made the argument. Did the author use evidence to support the main claim? Appeals to emotion? Specific word choice? If you take the SAT without Essay, the test length is three hours. However, if you take the SAT with Essay, the optional Essay adds 50 minutes. It also costs more to take the SAT with Essay: $64.50 vs $47.50 without the Essay. Don't automatically assume you must take the Essay. Whether it's important for you depends on which schools (and scholarships) you're applying to, and what the rest of your application looks like. I'll go into more depth later about how to decide which version of the SAT to take. See if you need to take the SAT with Essay to end up here! Currently, no Ivy League School requires students to take the SAT with Essay; the same is true for Caltech, Duke, Georgetown, Johns Hopkins, MIT, Northwestern, NYU, and UChicago. Many of these schools no longer even recommend students take the SAT with Essay, which is a huge turnaround from even a couple of years ago. Most liberal arts colleges do not require or recommend the SAT with Essay. However, there are a few exceptions: Soka University requires it, and Amherst College and Occidental College both recommend it. In general, most state schools also do not require the SAT with Essay, although there's still a significant portion which do. There tends to be some weird variance even within states. For example, all University of California schools require the SAT with Essay, but most of the California State University schools do not. Regardless of the types of schools you're applying to, don’t assume that they all ask for the SAT with Essay. Check with every school to make sure you understand their testing requirements. To take or not to take, that is the question. How to Decide Whether to Take the SAT Essay When making your decision about whether to take the SAT with Essay or the SAT without Essay, you'll need to consider the following four questions: #1: Do Any Schools I Want to Apply to Require the SAT Essay? If you’re applying to any school that requires the Essay, then you must take the SAT with Essay. If you take the SAT without Essay, your application will be incomplete and you won't get admitted. By contrast, if you apply to any schools that don't require the SAT Essay, you can still take the SAT with Essay since these schools will accept both types of SAT scores (with or without Essay). To reiterate, colleges that require the SAT Essay won't consider your score if you took the SAT without the Essay. The last thing you want to do is take the SAT without the Essay and get a good score- but then find out that one of your target schools requires you to take the SAT with Essay. Remember that some colleges change their application policies from year to year, so make sure to double-check the testing policies of the schools you’re applying to. #2: Do Any Schools I Want to Apply to Recommend the SAT Essay? If you're not applying to any schools that require the SAT Essay section but are applying to some that recommend it, then I'd still suggest taking it. This gives you another dimension schools can use to evaluate your application. However, there are some cases in which you shouldn't take the SAT with Essay as well. If, for some reason, you do not qualify for SAT fee waivers and paying the extra cost to take the SAT with Essay would be a financial burden to you, then please don't feel like you have to take it; in this case, it's fine to take the SAT without Essay instead. In addition, if you really struggle to write essays under time constraints (due to anxiety), you might want to opt out of the Essay. However, I only recommend this for students who normally have strong English and writing skills but struggle to write coherent essays when there's the added pressure of a time constraint. For example, do you get As on essays you can work on at home but Cs on in-class essays because you get easily nervous? If that's the case, taking the SAT with Essay might not be a good idea. #3: Am I Applying to Any Scholarships That Require an SAT With Essay Score? Many scholarships (such as National Merit) require you to submit SAT scores, and some specifically want SAT with Essay scores. Therefore, be sure to check the requirements of each scholarship you're planning on applying for. While scholarships that don’t require or recommend the SAT Essay should still accept your SAT with Essay score, scholarships that require the Essay section will not consider your SAT score if you took the no-essay version. #4: Will the SAT Essay Enhance My Application in Other Ways? Generally speaking, taking the SAT Essay if it's not required won't add a lot to your application. In truth, colleges that don't recommend or require the Essay really don't pay much attention to it. However, the Essay might be helpful for international students who want to prove they have strong English skills and who think they'll do especially well on it. If you fall into this category and feel confident that you'll get a high score on it (after doing practice essays, for example), definitely consider taking the SAT with Essay.
